Who is responsible for the maintenance of a sectional title scheme?

6 October 2015 by YourProperty

Dear YourProperty

Can you please advise who is responsible for the boundary wall of a complex – the owner of the property next to the boundary wall or the body corporate of the complex?

My question stems from the main borehole water pipe from the complex bursting due to high water pressure into my garden on three occasions now, which has resulted in a lot of damage to my garden as well as a lot of debris and mud in my drainage pipes and gutters.

The body corporate did not maintain the pipes to begin with and they  did not fix this problem properly the first time round.

I’ve since had to contact professional cleaners to clean out the mud and debris from the drainage pipes and the body corporate refuse to cover the cost of the cleaning,  providing me with multiple reasons, none of which are valid and they have not even come to inspect the damage to either my garden or the drainage pipe.

Kind regards
