Trustees mishandle sectional title scheme

Dear YourProperty

I own a flat in a sectional title scheme and have quite a few concerns about the trustees’ management of the scheme. The people who live in the building are not very well off which is probably where all of these issues initially stemmed from.

The building itself has not been maintained and the levies which were paid to the body corporate for maintenance purposes were stolen by the trustees and no repairs were ever carried out. At the same time, the previous body corporate took out a loan for repair work to be done on the building but the money has disappeared without any repairs being carried out.

I have since replaced the old trustees, who have now informed the owners that they are responsible for the repayment of the loan.

Please can you advise on the split responsibilities on sectional title flats between the body corporate and the homeowners and where we stand in light of the above?
