My late father bequeathed a residential property, a sectional title unit, to his daughter, my sister. The property was subject to a lifelong usufruct in favour of his wife, the surviving spouse, although the will did not stipulate whether the surviving spouse or the daughter is responsible for the expenses in respect of the sectional title property.
At the moment my mother is paying for the municipal rates and taxes. She is also paying the separately charged monthly levy on the sectional title unit, charged by the body corporate.
We are currently faced with the issue of my sister, the owner of the unit, refusing to pay for the expenses in respect of the property and talks with her to resolve this matter so far have been fruitless.
Please can you advise who is responsible for these payments?
