We were hired to perform some electrical work at a restaurant that was in a leased building and we were told by the tenant (the person who made the call to us to have the work done) that payment would come from the owner.
We contacted the owner and were told that “essentially” the payment would come from them but they wanted to speak with their tenant first and now the tenant is out of business and we have still received no payment from either party.
We do not have a written agreement from anyone, but obviously we were hired since we went into their building while they were there and we did the work.
The owners are now saying – since they have learned the tenant walked out on their lease – that they (the owners) never hired us and the tenants did so, therefore they are not responsible for paying for the improvements to their building.
Do we just take both to small claims court and let a judge decide?
