We live in a townhouse complex comprising of a few sectional title units. Following our annual general meeting it was decided to elect three trustees with one to serve as the chairman.
I would like to know if the trustees can be elected as such, even if they may not be the owners off a unit?
As I understand, the trustees are elected to see to the daily management of the complex.
May they decide on major improvements to the complex and the three trustees agree on their own to effect such improvements, without written consent and without prior consultation by the remaining owners?
As it is they (trustees) decide and implement any major improvements which is to be funded by means of a substantial increase of our monthly levies.
What does the law regarding body corporates say?
I would really appreciate it if you could share some light on the above matters.
