Confusion over sectional title trustees

15 February 2016 by YourProperty

Dear YourProperty,

I own a unit in a large sectional title complex and it has become somewhat unclear who the board of trustees are.

The board were initially elected, but the trustees changed from time to time as is usually the case.

Somewhere along the line a power struggle ensued and now we have an “old” versus “new” board scenario.

The “old” board maintain they are incumbent while the “new” trustees insist they are.

Due to this, there are arguments as to the validity of decisions taken and resolutions made at various meetings.

The new board won’t provide the names of some of their members, “fearing” intimidation.

I also suspect the new board wish to take control of the finances for personal gain. They also allege that the previous board were corrupt despite them using a managing agent and having financials audited.

How can we establish the identities of the new trustees?
