I am currently living in a sectional title complex, and have been relatively happy with the way in which things are being run, but lately I feel the body corporate is overly focused on issuing punitive fines.
The scheme where I stay is well managed and the body corporate is reasonably active, but seems intent on issuing fines for every transgression committed by residents.
Recently I had a small party at home where, admittedly, the music went on later than usual and was perhaps louder than usual as well. Some of my guests were also a bit loud when they left.
The following day one of the trustees approached me and gave me a notice to inform me that I had breached certain house rules of the complex and was being fined.
The fine that they have issued is excessive, not to mention unnecessary as this was a once off event and as far as I am aware, none of my neighbours had a problem with the party.
What I want to know is what right the body corporate has to issue fines in relation to breaches of the house rules, and whether I am obliged to pay them?
